The Durable Power of attorney appoints an agent and empowers that person to handle all of your financial affairs. There are strict North Carolina statutory requirements in drafting a Durable Financial Power of Attorney. The document should be drafted so as to be valid if you become incompetent. Care should be taken to name someone you trust to be appointed as your agent. The document must be notarized and is filed with the register of Deeds to become completely effective with financial institutions.
